Welcome to Picsi.Ai - Powered by InsightFace! Please read these Terms of Use ("Terms") carefully before using our services. By accessing or using our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.

1. Description of Services

Picsi.Ai provides state-of-the-art AI-powered face-swapping and morphing services using our own InsightFace technology. We are a wholly owned subsidiary of InsightFace.Ai. Our platform allows users to create AI-enhanced images and videos with features like face swapping, artistic blending, and more. These services are accessible through our website, Discord bot, and other designated platforms.

Our services are intended strictly for research and legal AI creation purposes. We do not condone or promote the use of our services for any illegal or unethical activities, including but not limited to replacing faces of individuals without their express permission or altering the faces of political figures, public officials, or other public figures.

2. Picsi.Ai Content and Intellectual Property

2.1 Picsi.Ai Intellectual Property

All content provided through Picsi.Ai, including text, graphics, images, software, and other materials ("Picsi.Ai Content"), is owned by Picsi.Ai or its affiliates and is protected by intellectual property laws. You may not use any Picsi.Ai content without our express written permission, except as provided in these Terms.

2.2 Use Restrictions

You agree not to:

• Sell or commercially use any part of our services without explicit permission.

• Copy, reproduce, distribute, publicly perform, or publicly display any part of our services.

• Modify, create derivative works based on, reverse engineer, decompile, disassemble, or attempt to extract the source code of the services, except as permitted by applicable law.

• Use the services for any illegal, unethical, or unauthorized purposes.

3. Usage Limitations and Restrictions

To ensure fair usage and the integrity of our services, Picsi.Ai reserves the right to implement rate-limiting measures. The use of bots, automated scripts, or any other automation tools to interact with our services is strictly prohibited unless explicitly authorized by us. Violations of these restrictions will result in permanent suspension of your account.

Picsi.Ai also employs advanced content filtering mechanisms. Any attempts to produce unauthorized or adult content are considered serious violations of our content guidelines and will lead to immediate account suspension to safeguard the integrity of our community. Other legal remedies will be pursued if necessary.

4. Indemnification

You agree to indemnify and hold Picsi.Ai, its officers, directors, employees, and agents harmless from any claims, disputes, costs, liabilities, damages, expenses, and judgments, including reasonable legal and accounting fees, arising out of or in any way connected with your use of the services or your violation of these Terms.

6. License and Commercial Use of AI-Generated Images

6.1 Free Users

Free users of Picsi.Ai may not use the images generated by our services for commercial purposes. Any use of AI-generated images by free users must comply with the licensing terms and should not infringe on any copyrights or trademarks of the original images.

6.2 Paid Users

Paid users are permitted to use AI-altered images from Picsi.Ai - Powered by InsightFace for commercial purposes, provided that both the source photo and target photo have no copyright issues. In order to use the images in any commercial way, paid users must also clearly attribute the AI-altered images to Picsi.Ai - Powered by InsightFace in all instances where the images are displayed, whether in physical or digital format. This attribution must also be included in the meta and EXIF data of digital images.

7. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS," WITHOUT WARRANTY OF ANY KIND. Picsi.Ai EXPLICITLY DISCLAIMS ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, QUIET ENJOYMENT, AND NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.

We do not guarantee that the services will meet your requirements or that they will be available on an uninterrupted, secure, or error-free basis. Your use of the services is at your own risk.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Picsi.Ai WILL NOT BE LIABLE FOR ANY INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES, INCLUDING BUT NOT LIMITED TO, LOST PROFITS, LOST REVENUES, LOST SAVINGS, OR LOSS OF DATA, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE SERVICES.

9. Governing Law and Dispute Resolution

9.1 Governing Law

These Terms and any disputes arising out of or relating to these Terms or the use of the services will be governed by the laws of the People's Republic of China, without regard to its conflict of laws provisions.

9.2 Arbitration

Any dispute arising out of or relating to these Terms or the use of the services will be resolved through binding, individual arbitration in accordance with the rules of the China International Economic and Trade Arbitration Commission (CIETAC). The arbitration shall be conducted in Suzhou, Jiangsu, China, in the Chinese language. You and Picsi.Ai agree to waive the right to a trial by jury or to participate in a class action.

9.3 Class Action Waiver

YOU AGREE THAT ANY CLAIMS YOU BRING AGAINST Picsi.Ai WILL BE IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

10. Changes to Our Terms

Picsi.Ai reserves the right to update these Terms from time to time at our sole discretion. If we make changes, we will notify you by posting the updated Terms on the Site. Your continued use of the services after any changes to the Terms constitutes your acceptance of the new terms.

11. Termination

Picsi.Ai may suspend or terminate your access to the services at any time, with or without notice, for any reason, including violations of these Terms. You may cancel your account at any time by contacting us at contact@picsi.ai. Upon termination, the relevant provisions of these Terms will survive.

12. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

entire agreement between you and Picsi.Ai regarding the use of the services. You may not assign or transfer these Terms without Picsi.Ai’s prior written consent. Picsi.Ai may freely assign or transfer these Terms.
